A journalist's complaint from 2019 claiming criminal intimidation led to the Bombay High Court to dismiss criminal proceedings against Bollywood actor Salman Khan. On Thursday morning, Justice Bharati Dangre, a single justice, issued the ruling.
Salman Khan filed a lawsuit in the High Court to overturn a summons order that was issued in response to a journalist's allegation that the actor had attacked the writer and taken his phone while the man was cycling through Mumbai.
Legal Case Against Salman Khan
The DN Nagar police station, where the charge was lodged, was asked to submit a report to the Magistrate Court. The Magistrate determined there was enough evidence to continue against Khan based on the "positive police report" required by Section 202 of the Criminal Procedure Code (CrPC) and other evidence.
The Magistrate summoned the accused to appear directly in court after observing that charges had been brought out against him under Sections 504 (intentional insult with purpose to provoke breach of peace) and 506 (criminal intimidation) of the Indian Penal Code.
Khan then petitioned the High Court, which in April 2022 stayed the ruling. Khan also requested that the charge against him be dropped.Senior attorney Aabad Ponda argued on behalf of Khan that he had merely instructed his bodyguards to prevent the journalist from taking pictures or recordings of him.A group from DSK Legal, including managing partner Anand Desai and associates Chandrima Mitra and Parag Khandhar, briefed Ponda as well as attorneys Agasthya Desai and Vikram Sutaria.
